Terms of Service

1. Agreement

This End User License Agreement ("Agreement") is a legal contract between you ("you" or "User") and APPROX TEKNOLOJI ANONIM SIRKETI ("we", "us", "our"), governing your use of the mobile application Alibi (the "App"). By installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control for personal, non-commercial use only.

3. Ownership

The App, including all intellectual property rights in the code, design, images, content, and trademarks, is and will remain our exclusive property (or our licensors). This Agreement does not grant you any ownership rights. All rights not expressly granted are reserved.

4. Account & Authentication

The App creates an anonymous account with a unique user ID (UUID) when you first use it. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate this Agreement.

5. Prohibited Uses

You must not, and must not allow others to:

• Use the App for any commercial purpose or on behalf of any third party without our prior written consent.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works based on the App.
• Attempt to bypass security or authentication mechanisms.
• Use the App to transmit, store, or process unlawful, harmful, abusive, defamatory, obscene, or objectionable content.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App, servers, or related systems.
• Collect, harvest, or otherwise obtain personal data from other users without their consent.

6. Credit Purchases & Payments

The App uses a credit-based system for image generation. Credits are purchased through in-app purchases processed via third-party payment processors (e.g., Adapty and the App Store). All fees are stated in the App and are billed in accordance with the terms displayed at purchase. You are responsible for taxes and any fees associated with your purchase. Each image generation costs 1 credit.

Refunds are subject to the App Store's refund policies and any applicable terms from our payment processors. We do not control the App Store refund process; contact Apple or Adapty for refund requests related to payments made through those platforms. Credits are non-refundable once purchased.

7. Updates & Modifications

We may provide updates to the App, including bug fixes, patches, and new features. Updates may be required to continue using the App. We reserve the right to modify, limit, or discontinue features or services at any time.

8. Termination

We may terminate or suspend your access to the App at any time, with or without notice, if you breach this Agreement. Upon termination, your license ends, and you must stop using the App and delete any copies in your possession. Termination will not relieve you of any payment obligations incurred prior to termination.

9. Disclaimer of Warranties & Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP (IF ANY) IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED TURKISH LIRA (TRY 100), WHICHEVER IS GREATER.

10. Indemnity

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of this Agreement, or your violation of any rights of another.

11. Privacy & Data

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and share data. By using the App, you consent to the collection and processing of information as described in the Privacy Policy.

12. Children

The App is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal data, contact us and we will take steps to delete the information.

13. Changes to This Agreement

We may amend this Agreement from time to time. If we make material changes, we will notify users via the App or by email. Your continued use of the App after such notice constitutes acceptance of the updated Agreement.

14. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to conflict of laws principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Türkiye.

15. Third-Party Services

The App integrates with third-party services (for example: Google Gemini for AI image generation, Firebase for analytics, and Adapty for payment management). Use of those services is subject to the respective third parties' terms and privacy policies. We are not responsible for third-party practices.
